ABC, CDW Raise Alarm on NLRB, EEOC Conflicts

May 11, 2022

On May 9, ABC and the Coalition for a Democratic Workplace sent a letter to the Senate Health, Education, Labor and Pensions Committee to voice concerns with the current tension between federal anti-discrimination laws and federal labor relations laws as implemented by the National Labor Relations Board and its general counsel.

On May 10, the HELP Committee interviewed President Biden’s nominee to the Equal Employment Opportunity Commission, Kalpana Kotagal. The CDW requested that she and the committee address the concerning enforcement trend from the NLRB that is “creating an impossible situation for the employer community where they will be forced to choose between compliance with federal antidiscrimination laws or federal labor relations laws, exposing employers to significant liability and employees to unsafe, hostile workplaces.”

The letter calls on the EEOC and NLRB to “work together to ensure employers understand their obligations under their respective laws and employees have the ability to collectively bargain without violating the rights and well-being of others.” Read CDW’s statement on the letter at MyPrivateBallot.com.

The Coalition for a Democratic Workplace is composed of hundreds of organizations representing millions of businesses that employ tens of millions of workers nationwide in nearly every industry. CDW members are joined by their mutual concern over regulatory overreach by the NLRB that threatens employees, employers and economic growth.
